Virginia Beach Short-Term Rental Ordinance: What to Do About It


New Virginia Beach law affects all AirBnB, VRBO, & vacation rental property owners.

Does your short-term rental property (or Airbnb or VRBO) comply with the new Virginia Beach ordinance going into effect on November 1, 2019? If not, there are some crucial, time-sensitive steps you’ll need to take. CGP Real Estate Consulting is here to help.


In January 2019, the Virginia Beach City Council voted to adopt a new ordinance to regulate short-term rentals (STRs), making changes to code and zoning regulations for properties rented out by private owners or through home-sharing companies such as Airbnb, HomeAway, or VRBO. The full ordinance states several new requirements for properties operating as STRs (and CGP broke the regulations down for you last week.)


To comply with the new short-term rental ordinance, what do I need to do?

If you own a Virginia Beach short-term rental property in the Sandbridge Special Service District, you’ll need to:

  • Make sure that your property meets all regulations from the new ordinance.

  • Complete the Zoning Administration’s STR Registration/Renewal Form.

  • Provide the zoning office proof of your registration with the Commissioner of Revenue (COR).

  • Provide a copy of all transient occupancy tax receipts paid to the COR prior to July 1, 2018. (Don’t worry, if you don’t have one readily available, just call 757-385-4515 for a copy.)

If you have a Virginia Beach STR and registration and taxes were filed with the Commissioner of Revenue before July 1, 2018:

  • Complete this form for the Zoning Administration.

  • Provide proof of registration with the Commissioner of Revenue (COR).

  • Provide a copy of all transient occupancy tax receipts paid to the COR prior to July 1, 2018. (Again, if you don’t have one readily available, you can just call 757-385-4515 for a copy.)

  • Make sure that your property meets all regulations from the new ordinance.

If you have a Virginia Beach STR and registration and/or taxes were NOT filed with the Commissioner of Revenue before July 1, 2018, or if you still have not registered your STR with the COR:

  • Complete this application for a Conditional Use Permit. (Learn more about those here.)

  • Complete the application for registration included in the above document.

  • Pay the $360 application and advertising fee.

  • Include a property survey or site plan. (If you need help facilitating a survey, CGP can help out.)

  • Include a written and drawn parking plan, accommodating one non-street parking spot per bedroom.

  • Provide proof of $1,000,000 or more in liability insurance.
